THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.6728 of 2016 ORDER:

Challenge in this writ petition is to the notice dated 12.02.2016 issued by the Adoni Municipality directing the petitioner to remove certain encroachments.

The petitioner submitted representation dated 23.02.2016 along with enclosures, receipt of which is evidenced by the stamp affixed thereon, to the Commissioner, Adoni Municipality. It appears that a separate representation was also submitted on 26.02.2016 to the Commissioner of the Municipality but the said representation does not bear evidence of receipt.

Be that as it may, as the petitioner has already responded to the notice dated 12.02.2016 and has also relied upon documents in support of his claim that there is no encroachment, the writ petition is disposed of directing the Adoni Municipality to consider the petitioner's explanation along with the supporting documents, afford him an opportunity of personal hearing and only thereafter take appropriate action in the matter in accordance with law.
