ORDER

This petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in Crime No.155 of 2019 of Hanamkonda Police Station, Warangal District, registered for the offences under Sections 363, 511,420, 354, 506, 354 (c) read with Section 34 IPC, against the petitioner/A1.

Learned counsel for petitioner requested this Court to direct the police concerned to follow the procedure under Section 41-A Cr.P.C.

Since the offences alleged are punishable with imprisonment for less than 7 years, before arresting the petitioner/A1, the Investigating Officer is bound to follow the procedure prescribed under Section 41-A Cr.P.C.

In view of the above, without going into the merits of the matter, the Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar1.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
