HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.23674 OF 2007 ORDER:
This Writ Petition is filed with the following prayer: "to issue Writ Order or Direction more particularly one in the nature of WRIT OF MANDAMUS, declaring the action of the respondent Nos.2 to 4 herein in not fixing the boundaries to the Nijam Tank situated at Mahabubabad Village and Mandal, Warangal District, despite the specific directions of the 1st respondent to fix the boundaries to the said tank as arbitrary, illegal, improper and consequently direct the respondents herein not to permit anybody to raise any permanent structures in the tank bed, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case."
2. The Tahsildar, Mahabubabad Mandal, Warangal District, the 3rd respondent, filed counter affidavit stating that the Assistant Director, Survey and Land Records, Warangal, conducted detailed survey of the subject lands and submitted his report, dated 03.01.2007, and called for the proposals for issuance of supplementary Sethwar. He submits that the District Collector, Warangal, the 1st respondent, negatived the proposals and instructed him and the Mandal Revenue Inspector, Mahabubnagar, to protect the shikam land of Nizam Cheroo.
3. This Court, by way of interim order, dated 07.11.2007, directed the respondents to fix boundaries to the subject Tank.
W.P.No.23674 of 2007 ARR,J However, the learned counsel for petitioner submits that though survey was conducted, boundaries were not fixed.
4. In view of the same, the Writ Petition is disposed of directing the respondents to fix boundaries to the subject Tank, if not already fixed, within a period of eight (8) weeks from the date of receipt of a copy of this order.
