This Contempt Case is filed alleging violation of the orders dated 25.08.2014 passed by this Court in W.P.No.24189 of 2014, wherein this Court has directed the first and second respondents to supply the stocks to the petitioner as long as the petitioner's fair price shop authorization is valid and subsisting.
It is the case of the petitioner that in spite of the directions of this
Court in the above writ petition, the respondents have stopped supply of stocks to the petitioner.
Counter affidavit is filed by the first respondent stating that even before the orders passed by this Court, the petitioner's authorization was suspended on 15.08.2014, as such, petitioner was not supplied stocks.
Learned counsel for the petitioner states that the first respondent is in the habit of violating the orders passed by this Court. When the above contention of the respondents was disputed, records were called for and the suspension order of the petitioner's fair price shop authorization passed by the first respondent was found in the records.
The first respondent passed order on 15.08.2014, though it is a public holiday, suspending the authorization of the petitioner's fair price shop.
This Court passed orders 25.08.2014 directing the first respondent to consider the case of the petitioner for supply of stocks, if his authorization is valid and subsisting. However, the first respondent passed impugned order on 15.08.2014 suspending the fair price shop authorization of the petitioner. In view of the same, I do not see any ground to entertain the Contempt Case against the respondents. Accordingly, the Contempt Case is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous applications, if any pending in this Contempt Case, shall stand dismissed. _________________________ A.RAJASHEKER REDDY, J 07.08.2015.
