HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 36426 of 2016 Order:
This Writ Petition was filed challenging the action of the third respondent in not appointing a suitable Special Public Prosecutor to conduct the trial in Sessions Case No.2 of 2008 before the XI Additional District and Sessions Judge and Special Sessions Judge for trial of cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, at Visakhapatnam and for a consequential direction to the said Court to complete the trial in a time bound schedule. After several adjournments, when the matter is taken up for consideration, learned Government Pleader produced before this Court a copy of G.O.Rt.No.182, Home (Courts-A) Department, dated 08.03.2017, entrusting the said case in S.C.No.2 of 2008 to Smt. Y. Sujatha, Additional Public Prosecutor, II Additional District and Sessions Court, Visakhapatnam.
In view of the said entrustment, learned counsel for the petitioners has no grievance with regard to appointment of the Public Prosecutor. However, since the matter is pending for the last several years, learned XI Additional District and Sessions Judge and Special Sessions Judge for trial of cases under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, at Visakhapatnam, shall dispose of the case as expeditiously as possible, if necessary by fixing day to day schedule at an early date.
The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.
As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
