THE HON'BLE SRI JUSTICE T.AMARNATH GOUD W.P.NO.3437 OF 2007 ORDER:

This writ petition is filed by the petitioner to declare G.O.Ms.No.1227 Revenue (UC1) Department dated 26-06-2006 issued by the 1st respondent, granting exemption to the excess land in favour of the 3rd respondent for the land belonging to the petitioner to an extent of 258 Sq.yards in Sy.No.6/2A 1 part of Maddelapalem village, K.R.M.Colony, Visakhapatnam as arbitrary and illegal.

Heard Sri G.Ramgopal, learned counsel appearing for respondent No.4, who is the legal representative of respondent No.3, and who was brought on record as per the orders of this Court in WPMP.No.24097 of 2010, dated 6.12.2010, and Ms.K.Krishnaveni, learned Assistant Government Pleader for Revenue (Andhra Pradesh). Since the matter pertains to the year 2007, this Court constrained to proceed with the case and dispose of the same on merits.

It is stated by Sri G.Ramgopal that as per the boundaries, the land in question is different from the land covered by G.O.Ms.No.1227 Revenue (UC1) Department dated 26-6-2006. 4.

Even as per the counter affidavit filed by the official respondents, it is stated that the land in an extent of 258 Sq.yards, upon which the petitioner is claiming, is different from the surplus land which is declared in G.O.Ms.No.1227 and that the petitioner has no locus standi. That apart there are disputes pending with

regard to subject land before the Court of IV Additional Junior Civil Judge, Visakhapatnam.

In view of the same, ,the writ petition is dismissed, without expressing any opinion on the merits, giving liberty to the petitioner to avail the remedy available to him under law as this Court cannot go into the disputed questions of fact with regard to the title of the property. No order as to costs. As sequel, the miscellaneous petitions pending if any shall stand closed.
