State Of Andhra Pradesh v. Athuru Damodara Reddy
HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT W.A.Nos.1147, 1149 OF 2015 & 8 OF 2016 PC: (Per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
These appeals are directed against the common order dated 01.07.2015 passed in W.P.Nos.16026, 16029, 16030 and 16062 of 2015, filed by the respondents. Respondents in the writ petitions prayed for mandamus declaring refusal order passed by the Sub-Registrar in registering the documents in question, as illegal and void. We are informed that the documents have already been registered and the Joint Registrar, Chandragiri while registering the document before him made the following endorsement: "Note:This document is admitted as per orders of the Hon'ble High Court of judicature at Hyderabad for the State of Telangana and Andhra Pradesh in W.P.Nos.16026,16029,16030 and 16062 of 2015 dt.1-7-2015.
This Registration shall not affect the rights of Government and shall be subject to further orders that may be passed by the revisional authority in the pending revision." Similar endorsements are made in respect of all the documents involved in these appeals. We are informed that the revision is pending where the State Government has challenged grant of patta in favour of the vendors of the respondents.
In view thereof, it is obvious that the registration of the document would be, as has been rightly endorsed by the Joint Registrar, subject to outcome of the revision. Moreover, in view of the judgment of the Full Bench in W.A.No.343 of 2015 and batch dated 23.12.2015, it is always open to the appellants to take appropriate remedy, if they so desired and advised for appropriate relief. Keeping all these options open, the writ appeals are disposed of.
Consequently, miscellaneous petitions, if any pending, also stand disposed of. _____________________ DILIP B. BHOSALE, ACJ ___________________ S.V.BHATT, J Date: 19.01.2016 Stp/Lrkm
