HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.1504 OF 2011 ORDER:

Learned counsel for the petitioners submits that they came to challenge the communication addressed by the respondentTahasildar, Shankerpally Mandal, vide L.R.No.B/112/2010, dated 12.01.2011, whereunder the Tahasildar had desired production of certain documents which according to the petitioners are not relevant for the purpose of mutating their names in the revenue record.

Learned Assistant Government Pleader for Revenue (Telangana) on the instructions submits that the petitioners never approached the office of the respondent after 12.01.2011 and never made any submission how and why the documents sought for were not relevant for the purpose of considering their request. Without entering into the controversy Writ Petition can be disposed of acceding to the request of the petitioners' counsel that he would instruct his clients to submit explanation and also submit the documents so far as they are relevant for the purpose of mutating their names. Petitioners' counsel also seeks liberty to challenge the order in the event of the respondent not considering the explanation submitted by the petitioners not being accepted.

The Writ Petition is disposed of accordingly with a direction to the respondent to take into consideration of the explanation that is offered by the petitioners including further explanation that may be offered by the petitioners. If the petitioners or their counsel desires a personal hearing that may be granted.

record shall be completed within a period of 12 weeks from today. It is needless to state that it would always be open for the petitioners to avail such remedies as available in law. Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
