THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON NO. 12834 OF 2015 ORDER:
This Writ Petition is filed by the petitioner seeking to declare the action of the 3rd respondent Sub-Divisional Police Officer, Bapatla, Guntur district in not accepting the representation of the petitioner for closing of the rowdy sheet opened against him in Cherukupalli Police Station i.e., 5th respondent vide C.No.6/SDPO/TML11 dated 20.4.2011 and further sought for a direction for payment of Rs.3,00,000/- towards compensation for the humiliation, harassment and agony caused by the respondents to the petitioner.
Heard Sri A.Ramesh Babu, learned Assistant Government Pleader for Home (AP).
In so far as the issue of payment of compensation is concerned, the same cannot be granted by this Court under Article 226 of the Constitution of India and accordingly, the said relief sought is dismissed.
In so far as considering the representation for closing the rowdy sheet is concerned, since the petitioner is more than 60 years old and presently there is no criminal case pending against him and also in the light of the Police Standing Order No.601 the petitioner is a senior citizen, the Writ Petition is allowed quashing the Rowdy Sheet opened against the petitioner in C.No.6/SDPO/TML11 dated 20.4.2011.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
