THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9802 of 2015 ORDER:

This criminal petition is filed by the petitioner - accused under Section 482 of Criminal Procedure Code seeking to relax the conditions imposed on the petitioner by the Court of the Special Judge for Economic Offences at Hyderabad vide order, dated 21.07.2015 in Crl.M.P. No.1522 of 2015 in C.No.VIII/48/02/2015-SIIB CPC. Heard and perused the material available on record. The order passed by the Court below while grating bail to the petitioner reads as under:

"In the result, petition is allowed and the petitioner is ordered to be released on bail on his executing a bond for Rs.1.00 lakh with two sureties for alike sum and he is further directed to attend before the Superintendent of Customs, Customs Preventive Comissionerate (CPC) Vijayawada twice in a week i.e. on every Monday and Thursday between 10.00 a.m. and 2.00 p.m. until further orders. He is further directed not to leave State of A.P. without prior permission from this court until further orders. He is further directed to deposit his passport before this Court, if not already deposited."

Learned counsel for the petitioner submitted that the petitioner is complying with the conditions imposed by the trial Court regularly and the Superintendent of Customs, SIIB Customs Preventive Commissionerate, Vijayawada has also completed investigation and therefore, the above conditions may be relaxed. Considering the facts and circumstances of the case, this Court is inclined to modify the conditions imposed by the Court below as follows: "The Petitioner is directed to report before the Superintendent of Customs, Customs Preventive Comissionerate (CPC) Vijayawada, as and when required instead of appearing twice in a week. The other conditions in the order of the Court below shall remain unaltered."

Accordingly, the Criminal Petition is disposed of.
