HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35609 of 2016 ORDER:

This writ petition under Article 226 of the Constitution of India is filed seeking to declare the action of the 4th respondent in registering the Crime No.187 of 2016, dated 22.09.2016, on the basis of the complaint of 5th respondent.

Heard and perused the material available on record. The main grievance of the petitioner is that the 5th respondent had encroached the adjacent land of the petitioner illegally and now tried to encroach the vacant site of the petitioner of 15 feet and on questioning about the same by the petitioner, the 5th respondent lodged the present complaint.

Considering the grievance of the petitioner, the 4th respondent is directed to complete the investigation in Crime No.187 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner.
