THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON NO.16295 OF 2017 ORDER: (per SK,J) The prayer of the petitioner in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleated to issue a Writ of Certiorari or any other appropriate Writ, Order or Orders Direction or Directions to quash the order of the Hon'ble Andhra Pradesh Administrative Tribunal in O.A.No.8606 of 2013 dated 17.03.2017 to the extent of granting interest @ 9% per annum on the pension and gratuity from 18.11.2003 only without granting the same from the date they became due on the retirement of the petitioner on 30.04.1994 and to issue a consequential direction to the respondents to pay interest to the petitioner on the retirement benefits like pension and gratuity from the day they became due on his superannuation on 30.04.1994 till the date of actual payment @ 9% per annum, and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

While so, Sri M.Rajender Rao, learned counsel representing Sri Vedula Srinivas, learned counsel for the petitioner, would state that in the light of the Circular Memo dated 06.06.2018 issued by the Special Chief Secretary to Government (CT, Excise & R&S) (FAC), Revenue (Vigilance-II) Department, Government of Andhra Pradesh, requesting the Commissioner of Commercial Taxes, Andhra Pradesh, to take immediate necessary action to pay interest @ 9% per annum on the pension minus provisional pension and on gratuity to the petitioner herein in implementation of the order dated 07.03.2017 passed by the Tribunal in O.A.No.8606 of 2013, the petitioner does not wish to pursue this case. Recording the said statement, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
