HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD CRIMINAL PETITION No.7930 of 2011 ORDER :

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/A.1 to quash the proceedings in Crime No.199/2011 of Jadcherla Police Station, Mahabubnagar District, registered for the offence punishable under Section 420 of IPC.

Learned counsel for the petitioner submits that since this Criminal Petition is filed in the year 2011, investigation may be proceeded further by giving a direction to the police to follow the procedure prescribed under Section 41-A of Cr.P.C., and abide by the directions issued by the Apex Court in ARNESH KUMAR v. STATE OF BIHAR AND ANOTHER1. Learned Public Prosecutor appearing for the 1st respondent-State submits that he has no objection for the said course of action.

Having regard to the facts and circumstances of the case, the Investigating Agency is directed to proceed with the investigation by following procedure prescribed under Section 41-A of Cr.P.C., and abide by the directions issued by the Apex Court in ARNESH KUMAR's case (supra).

GSP,J Crl.P.No.7930 of 2011 Subject to the above directions, this Criminal Petition is disposed of. Interim stay granted by this Court on 05.09.2011 shall stand vacated.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
