O R D E R

The petitioner, a life convict in District Jail, Nizamabad, was granted parole for one month i.e. from 08.10.2015 to 08.11.2015 pursuant to G.O.Rt.No.694, Home (Legal) Department, dated 20.08.2015. Appearing as a party in person, he states that he made a representation on 26.10.2015 to the Principal Secretary to Government, Home Department, Government of Telangana, seeking extension of his parole on the ground that his wife was not well and that there is no other family

member to take care of her. Aggrieved by the inaction of the State upon the said representation, he filed the present writ petition. Learned Assistant Government Pleader for Home, on oral instructions, informed this Court that the petitioner's application was considered and rejected. However, he is not in a position to place the said order of rejection before this Court. He also concedes that the said order has not been communicated to the petitioner. When the petitioner's parole was to expire on 08.11.2015 and he made a representation for extension thereof as long back as on 26.10.2015, the authority concerned should have passed appropriate orders expeditiously so as to give an opportunity to the petitioner/ party in person to seek appropriate legal remedies.

As it is fairly stated by the learned Assistant Government Pleader that the order of rejection has not even been communicated to the petitioner, it shall not be acted upon for a period of one week after communication to the petitioner and he shall not be sent back to prison during that period. The writ petition is disposed of with the above direction. Pending miscellaneous petitions shall stand closed in the light of this final order. No order as to costs.
