HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO WRIT PETITION No.21594 OF 2017 ORDER:

Heard the learned counsel for the petitioner and also the learned Govt. Pleader for the Land Acquisition representing the respondents and perused the prayer in the Writ Petition, supporting affidavit and the written instructions received by the learned Govt. Pleader and the material on record. The prayer in the Writ Petition is that the petitioner is owner of the lands to an extent of Ac.3.36cents dry of Peddaravigudem village, Kakkanur Mandal, of West Godavari district which is proposed to be acquired for the Polavaram project however, instead of entering the name of the petitioner, the respondents are trying to pay compensation to one Ramanujacharyulu S/ o Narasimhacharyulu. As per the written instructions there are rival claims and it is left open to the petitioner to submit any proof regarding his entitlement for no award so far passed.

Having regard to the above, the Writ Petition is disposed of directing the petitioner to submit written representation with documentary proof by approaching 3rd respondent within one week from the date of receipt of the order for the 3rd respondent to consider and pass appropriate order in deciding entitlement of the petitioner. As a sequel miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
