This Contempt Case is filed alleging wilful disobedience of Order, dated 26-08-2012 in W.P.No.12146 of 2013, by the respondent.
By the above-mentioned Order, this Court has stipulated the time limit of two weeks, from the date of the petitioners producing evidence of withdrawal of CCCA.Nos.279, 280 and 281 of 2007, to the respondent to consider and dispose of the former's applications for regularisation of the lands admeasuring Acs.5-00 cents each in various survey numbers. Alleging wilful disobedience of the said order, the writ petitioners filed this Contempt Case.
On 01-10-2015, the learned Government Pleader for Revenue (Assignment) (TS) placed before the Court, Memo No.19389/Assn.II/1/2013, dated 04-09-2015, whereby the respondent has rejected the petitioners'
claim for regularization of the lands in question. However, as there is an inordinate delay in passing the order, this Court has called upon the respondent to file an affidavit explaining the delay. Mr.Sunil Sharma, Principal Secretary to Government (TR & D) Department, who is temporarily holding Full Additional Charge (FAC) of the Principal Secretary to Government, Revenue Department, in the absence of the respondent, who is stated to be on official training, filed an affidavit wherein he has explained the delay. As per this affidavit, the delay occurred mainly on account of the failure of the Collector, Hyderabad, to send report till 13-08-2015.
In the light of the explanation offered by the Principal
Secretary holding FAC of the Principal Secretary, Revenue Department, and having regard to the fact that the respondent has passed an order al beit belatedly rejecting the claim of the petitioners, the Contempt Case is closed.
