HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.12889 of 2019 ORDER:
With the consent of both parties, this writ petition is being disposed of at the admission stage.
This writ petition is filed seeking the following relief: "...to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus, declaring the action of the 2nd respondent in not awarding weightage marks for qualification experience though the petitioner is fully eligible for the same as illegal, arbitrary, unconstitutional and violation of Article 14 & 21 of Indian Constitution and further direct the 2nd respondent to award weightage marks for qualification experience and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case." Heard learned counsel for the parties.
It has been contended by the petitioner that she is fully eligible and qualified to be appointed to the post of Pharmacist Grade-II and the respondents have issued a recruitment notification on 25.01.2018. As per the said notification, the respondents have awarded certain weightage of marks for the period from the date of acquiring requisite qualification. Inadvertently, the petitioner has not uploaded her qualification, and the moment it has come to her knowledge about uploading of the documents in respect of qualification, she has submitted a representation to the 2nd respondent on 19.07.2018, requesting to consider her case for grant of weightage of marks for the
period from the date of acquiring qualification. But, so far the respondents have not passed any orders on the said representation nor they are considering the case of the petitioner for grant of weightage of marks for the period from the date of her acquiring qualification. Learned counsel for the petitioner submitted that appropriate orders be passed in the writ petition directing the respondents to consider the representation submitted by the petitioner and let them pass appropriate orders on the said representation. Learned Standing Counsel appearing for the 2nd respondent had submitted that the case of the petitioner will be considered and appropriate orders, in accordance with Rules, would be passed on the representation submitted by the petitioner.
This Court, having considered the submissions made by learned counsel for the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation dated 19.07.2018 submitted by the petitioner and pass appropriate orders, in accordance with Rules, within a period of four weeks from the date of receipt of a copy of this order. With the above observations, the writ petition is disposed of. No order as to costs.
