HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE WRIT PETITION No. 14867 OF 2010 ORDER: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the parties.
On 28-06-2010, the following order was passed: "As matters stand, there is no evidence of any order having been passed under Section 54 (3) of the Wakf Act, 1995. In the absence of such order the intervention of the Revenue Authorities with the construction being made by the petitioner appears to be without legal basis. The learned counsel for the petitioner states that the construction made by the petitioner shall be at her own risk and she will not claim any equities thereafter. In such circumstances, there shall be a direction to the Revenue Authorities not to interfere with the construction being made by the petitioner in the subject premises pending further orders."
This Court is informed that Writ Petition No. 341 of 2011 was filed by the petitioner and it was dismissed on 19-01-2011 with liberty to the petitioner to file appropriate proceedings before the Wakf Tribunal challenging the action of the Revenue Authorities. Accordingly, the petitioner has filed proceedings before the Wakf Tribunal, bearing O.S No.74 of 2011.
In view thereof, nothing further survives in this petition. Writ petition is accordingly disposed of as rendered infructuous. Miscellaneous petitions, if any, also stand closed. No order as to costs.
