THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.40187 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to quash the FIR No.130 of 2016.

The case of the petitioners is that the petitioners have taken Rs.1,05,000/- from the 4th respondent on 11.06.2015 on the pretext of sending the 4th respondent to Saudi Arabia on working visa for carpentry work and after going to Saudi Arabia, the 4th respondent got to know that he has got tourist visa in the place of working visa. Basing on the said complaint, the 3rd respondent registered the same as FIR No.130 of 2016 for the offences punishable under Section 420 IPC and Section 10/24 of the Immigration Act. The grievance of the petitioners is that they are innocent of the offences alleged and that they are falsely implicated in the said crime and that any further action taken by the 3rd respondent would cause prejudice to the petitioners and damage their reputation in the society.

Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in FIR No.130 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 22nd November, 2016 KL
