THE HON'BLE JUSTICE G.SRI DEVI Criminal Revision Case No.648 of 2019 ORDER:
This Criminal Revision Case, under Section 397 read with 401 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ Accused Nos.2 to 4 against the order dated 15.04.2019 passed in Crl.M.P.No.132 of 2019 in C.C.No.470 of 2017 by the XXII Additional Metropolitan Magistrate, Cyberabad at Medchal, Ranga Reddy District, whereby the learned Magistrate dismissed the discharge petition filed by the petitioners herein.
2. Though the present revision is filed questioning the order dated 15.04.2019, referred to above, at the time of arguments, learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court.
3. The learned Additional Public Prosecutor submits that since the identity of petitioners is not in dispute in the present case, their presence in the above C.C. may not be necessary on every date of adjournment.
4. Having regard to the facts and circumstances of the case and considering the rival submissions, the personal appearance of the petitioners in C.C.No.470 of 2017 on the file of XXII Additional Metropolitan Magistrate, Cyberabad at Medchal, is hereby dispensed with unless and until their presence is so warranted by the Court below.
5. Accordingly, the Criminal Revision Case is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
