O R D E R
This writ petition is filed for a direction to the respondents to consider the representations of the petitioner stated to have been made on different dates, for collection of offerings of Dargah Hazrath Jahangir Peeran Rh., situated at Inmulnerva village, Kothur Mandal, Rangareddy District, Telangana State for the year 2019-20.
Learned counsel for the petitioner submits that subsequent to the filing of the writ petition, the 2nd respondent - State Wakf Board, represented by its Chief Executive Officer, passed the proceedings in memo F.No.13/DJP/Auc/RR/201819/ZII dated 29.06.2019, rejecting the claim of the petitioner and issued tender notification for auction / tender for right to collection of offering in the Hundies of the institution. He submits that petitioner intends to challenge the memo dated 29.06.2019 on the ground of jurisdiction, and the petitioner also intends to participate in the tender process, therefore, he may be given liberty for the same. Mr. Azam Khan, learned Standing Counsel for Wakf Board submits that Section 25(1)( c ) of the Wakf Act, 1995 empowers the Chief Executive Officer of the Wakf Board to issue proceedings in memo dated 29.06.
2019, and he is well within his jurisdiction to issue the said memo. Having regard to the facts and circumstances of the case, writ petition is disposed of granting liberty to the petitioner to challenge the proceedings dated 29.06.2019, and also participate in auction proceedings. Interlocutory applications pending, if any, shall stand closed. No order as to costs.
