THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.8710 OF 2017 ORDER:

This petition is filed by the petitioner- A2 under Section 482 Cr.P.C. to quash the proceedings in C.C.No.283 of 2016 on the file of the Assistant Sessions Judge, Bapatla, which took cognizance of the offence punishable under Section 306 IPC.

Heard the learned counsel for the petitioner, the learned Public Prosecutor representing the State and perused the record.

The material collected reveals the overt-acts against the petitioner herein-A2. The petitioner also has a right to argue about her innocence before the charges are framed. It is left open to the trial Court to determine whether the petitioner can be proceeded in the above case or not. No observation is made with regard to accusation or otherwise of the petitioner at this stage.

With this observation, the Criminal Petition is dismissed. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
