ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Revenue.

Petitioner claims to be owner and in possession of the land to an extent of Ac.2.08 1⁄2 guntas, Medipaly village of NTPC, Ramagundam mandal, Peddapally district. Petitioner alleges that when two persons viz., Alugonda Srihari and Akoju Shivakumar along with others tried to encroach his land, he filed suit against the said persons in O.S. No. 13 of 2018 and O.S. No. 73 of 2018 on the file of I Additional Junior Civil Judge, Godavarikhani and pending said litigation, the defendants in the said suits, trespassed into his land and started construction claiming that the said land belongs to them. In such circumstances, petitioner submitted a representation to the 2nd respondent dated 23.4.2019 along with challan to demarcate survey No. 574. Alleging inaction on the said representation, this writ petition is filed.

Since petitioner claims to have submitted representation for demarcation of Survey No. 574, without expressing any opinion on the merits of the matter, the Assistant Director, Survey and Land Records/ 2nd respondent is directed to process the application submitted by the petitioner and conduct the survey by following due process of law and communicate the decision to the petitioner within two weeks from the date of receipt of copy of this order. No costs. Miscellaneous petitions, if any pending, are closed.
