THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3296 of 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner/accused No.9 seeking bail in the event of his arrest in connection with Crime No. 130 of 2022 on the file of Ameenpur Police Station, Sangareddy, registered for the offences punishable under Sections 143, 147, 148, 341, 307 r/w.149 IPC, 27 of Arms Act. 2.

The facts of the case are that the present crime came to be registered on 06.04.2022 against accused Nos.1 to 9 on the allegations that the defacto complainant was attacked in the land in Survey No.1 to 220, Ilapurthand, Ameenpur, when he along with his brother went to observe the said land, some persons were demarcating plots in the said land. When questioned, the said persons attacked, having entered into unlawful assembly. The allegation against this petitioner is that the petitioner made a call to the

accused who did the said plotting in the land of defacto complainant.

The learned Senior Counsel appearing for the petitioner submits that the petitioner has nothing to do with the land or the plots demarcated therein and states that the petitioner would never enter into the said land or has nothing to do with the land in question. Apart from the confession of co-accused that the petitioner had made a call to the accused prior to the incident of attacking the defacto complainant and his brother, there is no other evidence to implicate this petitioner. For the said reason and also for the reason of his undertaking that he has nothing to do with the land and he was falsely implicated in this case, the petitioner, who is a practicing advocate and 50% disabled is granted anticipatory bail subject to the following terms and conditions:

1) The petitioners/ accused No.9 is directed to surrender before the Station House Officer, Ameenpur Police Station, Sangareddy District, and on such surrender, the said Station House

Officer shall release the petitioner/ accused No.9 on bail on his executing a personal bond to the tune of Rs.25,000/- (Rupees twenty five thousand only) with two sureties to the like sum each to his satisfaction.

2) The petitioner/ accused No.9 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

3) The petitioner/accused No.9 shall attend the concerned police station on every Sunday for two months or until filing of charge sheet, whichever is earlier.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
