THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CRIMINAL PETITION No.285 of 2015 ORDER:

This petition is filed under Section 407 Cr.P.C. to withdraw M.C.No.41 of 2015 from the file of the Judicial Magistrate of First Class at Nandyal, Kurnool District and transfer the same to the file of the VI Metropolitan Magistrate, Cyberabad at Medchal. The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the transfer criminal petition with a liberty to file a petition under Section 126 (2) Cr.P.C.

Permission is granted.

Hence, the Transfer Criminal Petition is dismissed as withdrawn with a liberty to the petitioner to file a petition under Section 126 (2) Cr.P.C. before the trial Court. If the petitioner files a petition under Section 126 (2) Cr.P.C., the trial Court is hereby directed to dispose of the same in accordance with law. Consequently, Miscellaneous Petitions, if any, pending in this Transfer Criminal Petition, shall stand closed.
