HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.13087 OF 2019 ORDER:

This Writ Petition has been filed challenging action of the respondents in finalizing selection to the post of Assistant Statistical Officer in pursuance of the notification dated 12.06.2018 without following Rule 6A of the Telangana State Public Service Commission Rules (for short 'Rules').

2. Learned Standing Counsel, on instructions, has informed this Court that respondent No.2 has followed Rule 6A while finalizing the selection, and some of the candidates who were placed in the selection list and who gave option to relinquish their posts, have joined without relinquishing their posts, except one candidate and even that one post has been offered to next meritorious candidate.

3. The learned Standing Counsel further submits that there is not even a single vacant post so as to consider the case of the petitioners who are contending that they are the next meritorious candidates. The learned Standing Counsel has further informed the Court that the 26 posts were reserved in pursuance of the direction given by the Division Bench in Writ Appeal No.402 of 2019 dated 03.06.2019 and rest of the posts have been filled up.

4. This Court, having considered the rival submissions made by both parties, is of the view that if there are vacant posts consequent upon relinquishment by selected candidates, the case of the petitioners can be considered, but, as per the contention of

the learned Standing Counsel for respondent No.2, none of the selected candidates have relinquished their posts.

5. In view of the above, the relief sought for by the petitioners cannot be granted. Therefore, the Writ Petition is dismissed. No order as to costs.

Miscellaneous Petitions, if any pending, in the writ petition stand closed.
