THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.3308 of 2022 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973, is filed by the petitioner, who is arrayed as accused No.5, to grant anticipatory bail in the event of his arrest in connection with Crime No.54 of 2022 of Achampet Police Station registered for the offences punishable under Sections 420 of Indian Penal Code and Section 5 of Explosive Substance Act.

Heard the learned counsel appearing for the petitioner/A-5 and the learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

It is alleged that on credible information police seized explosive materials at the instance of Accused No.1 and 2. On the basis of confession of Accused No.1 and 2 the petitioner is shown as accused No.5, who is holding license to deal with the explosive

substances. Other than the confession of accused Nos.1 and 2 there is no other evidence to show any kind of involvement of illegal possession of explosives seized from the Accused No.1 and 2.

4. In the said circumstances, the Criminal Petition is allowed and the petitioner/Accused No.5 is granted anticipatory bail subject to the following terms and conditions:

(1) The petitioner/A-5 is directed to surrender before the Station House Officer, Achampet within a period of (10) days from the date of this order and on such surrender, the petitioner is directed to be released on bail on his executing a personal bond to the tune of Rs.50,000/- (Rupees fifty Thousand only) with two sureties to the like sum each to his satisfaction.

(2) The petitioner/A-5 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

(3) The petitioner shall appear before the concerned police on every Monday and Thursday for a period of three months or till filing of charge sheet, whichever is earlier . Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
