HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition Nos.14995, 15065, 15081, 15232, 15241 and 15242 of 2014 Common Order:

All these Writ Petitions are being disposed of by this common order with the consent of the learned counsel for the petitioner and that of the learned counsel for the respondents 2 and 3, as the point raised in all the Writ Petitions is one and the same.

The Writ Petitions were filed challenging the notices of demand, pursuant to the exercise of powers contained in the Employees State Insurance Act, 1948, on the ground that the provisions of the said Act are not applicable to the petitioner.

Learned counsel for the petitioner as well as the learned counsel for the respondents submits that the point raised in these Writ Petitions is no longer res integra and covered by a decision of this Court in W.P.No.6363 of 2009 and batch dated 06.10.2015 and the said order of the learned single Judge was confirmed in W.A.No.200 of 2016 and batch dated 16.03.2016.

In view of the same, all the Writ Petitions are dismissed. However, it is open to the petitioner to file applications seeking exemption as per the provisions of the Act. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in these Writ Petitions shall stand closed.
