HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1744 of 2014 ORDER:

This Court by order dated 11.03.2014 passed interim direction directing the SubRegistrar, Tirupathi Rural, Chittoor District to receive and process the deed of conveyance in respect of lands in Survey Nos.497/2, 497/3, 497/4, 497/5, 497/6, 497/7, 497/8 and 499/2 of Avilala Village, Tirupati Rural Mandal, Chittoor District, if the letter of the Revenue Divisional Officer vide Letter No.L.Dis.No.3993/92, dated 03.03.1993 to the Vice Chairman, Tirupathi Urban Development Authority, Tirupathi, is in force and release the same if the same is in accordance with the Registration Act, 1908 and the Indian Stamp Act, 1899. Alleging non-compliance of the said order, this contempt case is filed.

2. The respondent filed counter-affidavit. It is categorical assertion of the respondent that petitioners have not presented any document before him and the person whose is impleaded as respondent in contempt case was transferred and relieved on 03.11.2014. Thus, according to the respondent, during his tenure, no document was presented before him and, therefore, the question of disobedience of the orders of this Court does not arise.

3. Counsel for the petitioners is not able to show any proof of presentation of the document before the Sub-Registrar and Sub-Registrar refused to receive the same more so when the Sub-Registrar categorically asserts that no such document is presented for registration.

4. Having regard to the same, I cannot hold that the registering authority committed contempt of the orders by not complying with the direction issued by this Court. Therefore, the contempt case is closed. However, it is always open to the petitioners to work out their remedies. Miscellaneous petitions pending, if any, in this contempt case shall stand closed.
