THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.37192 OF 2015 ORDER:

Heard.

The only grievance of the petitioners is that their representations, dated 28.09.2015 and 23.10.2015, made before the Joint Collector-I Ranga Reddy District, the 3rd respondent, are not being considered. The petitioners claim to be the legal heirs of one Uppari Mallaiah and that their agricultural land admeasuring Acs.10.00 in Survey Nos.288/6A/1 and 288/1FA of Saireddygudem Village, Kandukuru Mandal, Ranga Reddy District is being acquired for the purpose of Pharma City by the Government. Alleging that two brothers of the petitioners have fraudulently got mutated the said land in their names in the revenue records and claiming compensation, the petitioners filed the aforesaid representations before the 3rd respondent asserting that they are the legal heirs and seeking directions for consideration of the said representations, the present Writ Petition is filed.

Learned Government Pleader for Revenue submits that as on today, no proceedings under the Land Acquisition Act, 1894 are initiated and even according to the petitioners, only a meeting for the purpose of securing consent for acquisition of the lands was held in the village.

Since there is no land acquisition proceedings initiated as on today, if the petitioners seek to assert their claim over the property as aforesaid, it is for the petitioners to produce the necessary documents before the 3rd respondent in continuation of their representations, as

the 3rd respondent cannot on his own determine the legal heirs of any deceased pattadar. The petitioners are, therefore, free to approach the 3rd respondent by producing the documents in support of their claim and request the 3rd respondent to consider their claim in the event of acquisition of the land by consent and negotiations. If the documents are received by the 3rd respondent, as stated above, the same shall receive due attention of the 3rd respondent if and when any such acquisition by negotiation is held.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
