THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CIVIL REVISION PETITION No.5605 of 2015 ORDER:

Sri K.V. Bhanu Prasad, learned counsel for the petitioners, represented that the petitioners filed an application under Order XXI Rule 97 CPC raising obstruction/ objection for delivery of possession claiming that they are in possession of the schedule property. But, however, though the Executing Court granted interim order of status quo initially, it did not extend the same after vacation. Aggrieved by the Order, the present Revision is filed and this Court by Order dt. 23.12.2015 granted interim order of status quo and it is in force till today.

During hearing, learned counsel for the petitioners requested to this Court to pass an Order directing both parties to maintain status quo while directing the Executing Court to dispose of the application filed under Order XXXIX Rule 1 and 2 CPC expeditiously. Sri T. Venkateswara Reddy, learned counsel for the respondents, did not oppose the petition strongly.

In view of the request made by the learned Counsel for the petitioners, taking into consideration the pendency of the petition for more than 3 years and subsisting order of status quo, the Executing Court is directed to dispose of E.A.No.95 of 2015 in E.P.No.170 of 1992 pending on the file of II Additional Senior Civil Judge at Warangal, within a period of three months from the date of receipt of a copy of this Order, while directing both parties to maintain status quo till such time.

With the above direction, this Civil Revision Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
