HON'BLE DR. JUSTICE B. SIVA SANKARA RAO TRANSFER CRIMINAL PETITION No.175 of 2017 ORDER:

Heard learned counsel for the petitioners/accused, appellants of Crl.A.No.1023 of 2013 pending on the file of Metropolitan Sessions Judge, Hyderabad, and also learned Public Prosecutor representing the Assistant Commissioner (Prosecution) of Customs and Central Excise, the complainant. Pursuant to the judgment of this Court in Crl.P.No.5846 of 2014, it is very clear that against any order of the economic offence Court, no appeal or revision lie before the Court of Sessions, but for before the High Court.

Having regard to the above, the appeal filed before the Court of Session entertained despite non-maintainability earlier to the rendering of the judgment, thereby the Transfer Criminal Petition is allowed by transferring the same from the I Additional Metropolitan Sessions Judge Court, Hyderabad, to the High Court.
