O R D E R

Aggrieved by the inaction of the respondents in considering the claim of the petitioner for releasing family pension and other retirement benefits of her deceased husband, even after lapse of more than five years, present writ petition is filed.

Learned Assistant Government Pleader for Home (Services), on instructions, would submit that the petitioner is the second wife and she is not entitled for family pension and other retrial benefits of late V.Laxmaiah, who worked as Police Constable and died on 27.06.2013, after retiring from service. Learned counsel for the petitioner submits that as the first wife passed away, late V.Laxmaiah, married the petitioner and as such she is entitled for his retrial benefits.

These aspects have to be examined as per rules by competent authority. In view of the above averments, without expressing any opinion on merits, writ petition is disposed of directing the competent authority to consider the representation of the petitioner dated 07.03.2018 in accordance with law and pass appropriate orders within a period of four months from the date of receipt of a copy of this order.
