WRIT PETITION No.18029 of 2008 ORDER:

This writ petition, under Article 226 of the Constitution of India, is filed seeking the following relief:

"To issue a Writ or an Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in not enhancing the rents payable to the petitioner for occupying the building bearing H.No.4-50, situated at Old Town Road, Tanuku, West Godavari District, for AKTP ZP High School, in spite of guidelines issued by the State Government as illegal, unconstitutional and consequently direct the respondents to pay the arrears after enhancing the rent from May 1990 with interest at 25% P.A. on delayed payments."

2. When the matter is called, it is represented by the learned counsel for the petitioner so also the learned Standing Counsel for the respondents 3 and 4 that pending writ petition some amounts were paid to the petitioner herein. It is also the submission of the learned counsel for the petitioner that the respondents herein did not properly calculate the amounts due and did not completely pay the amounts to the petitioner.

It is also brought to the notice of this Court that pending the writ petition, petitioner herein filed representation dated 09.05.2009 before the respondents herein for the alleged unpaid arrears.

3. The learned counsel for the petitioner has made a request to issue directions to the respondents herein to take appropriate action on the representation said to have been submitted by the petitioner herein on 09.05.2009. The said request is accepted as reasonable.

4. Without expressing any opinion on merits and demerits of the matter, for the aforesaid reasons, the writ petition is disposed of, directing the respondents 2 and 3 to consider the above representation dated 09.05.2009 said to have been submitted by the petitioner herein

and pass appropriate orders, in accordance with law, within a period of three months from the date of receipt of this order. Pending Miscellaneous Petitions, if any, shall stand disposed of. No order as to costs.
