SHANKAR NARAYANA WRIT PETITION No.29742 of 2015 ORDER : (Per Justice R.Subhash Reddy) In this writ petition, the petitioner has questioned the e-auction notice dated 11.09.2015, to sell the Flat bearing No.406 in 3rd floor covered by Sy.Nos.314, 313/2, 313/3, admeasuring 721 square feet, situated at Nirmal Ratna Apartments, Gangaram, Chandanagar village of Serilingampally Mandal in Ranga Reddy District. When the matter is called for hearing, it is submitted that pursuant to the impugned e-auction notice, dated 11.09.2015, auction scheduled to be held today is not conducted for want of bidders and respondents are intending to initiate fresh proceedings, and hence, the subject matter of writ petition has become infructuous.

In that view of the matter, the writ petition is dismissed as infructuous. However, if any fresh notice is issued, liberty is granted to the petitioner to question such notice before the Debts Recovery Tribunal under Section 17 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. Pending miscellaneous applications, if any, shall stand closed. No costs.
