Heard the learned counsel for the petitioner and the learned Government Pleader for Home.

The grievance of the petitioner is that the 3rd respondent is summoning the petitioner and his father without there being any crime registered and detaining them and his father in the police station for hours together. Learned Government Pleader has received instructions, which state that on the date of instructions i.e., 31-03-2015 no complaint was received and no criminal case is registered against the petitioner. Hence, the question of summoning the petitioner and his father does not arise. It is stated that the respondent police are only concerned with the maintenance of law and order. It is also pointed out that the petitioner has not mentioned any date on which the respondent police summoned the petitioner and his father and interfered with the civil dispute.

Since no case is pending against the petitioner, the allegation of the petitioner that police have summoned him and his father and interfered with the civil dispute is found to be wholly unsubstantiated. Therefore, the writ petition is filed merely on apprehension and the same is liable to be dismissed. Accordingly, the writ petition is dismissed. No order as to costs. Miscellaneous applications, if any, shall stand closed. _______________________ VILAS V.
