Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (A.P.) appearing for the respondents.

An order of suspension of the fair price shop of the petitioner herein passed by the Revenue Divisional Officer, Atmakur Division, Nellore, Sri Potti Sriramulu Nellore District, respondent No.3 herein, vide proceedings Rc.D.136/2018, dated 14.02.2018, is under challenge in the present writ petition. 3.

The material available before this Court discloses that in response to the show cause notice, the petitioner herein submitted an explanation on 17.02.2018. It is the contention of the learned counsel for the petitioner that the issue pointed out by respondent No.3 is purely technical in nature and that there is no illegality on the part of the petitioner. It is further submitted by the learned counsel that the facts and circumstances of the case do not warrant the issuance of the impugned order of suspension. 4.

On the other hand, it is submitted by the learned Government Pleader that the enquiry pursuant to the show cause notice and suspension order is pending before respondent No.3. 5.

Having heard the learned counsel for the petitioner and the learned Government Pleader, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the writ petition with a direction to respondent No.3 to pass final

orders pursuant to the show cause notice, dated 14.02.2018, by taking into consideration the explanation offered by the petitioner herein within a period of six (6) weeks from today. It is further made clear that if no orders are passed within the period stipulated, the authorization of the petitioner herein shall be restored.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
