HON'BLE SRI JUSTICE M. SEETHARAMA MURTI S.A.No.823 of 2012 JUDGMENT:

This second appeal is filed by the appellant/petitioner assailing the judgment and decree dated 23.09.2011 passed in A.S.No.63 of 2010 on the file of the IV Additional District Judge, Kurnool in partly allowing the appeal by reversing the order dated 31.05.2010 made in I.P.No.7 of 2007 on the file of the Court of the Senior Civil Judge, Nandikotkur.

When the matter is taken up, it is represented by the learned counsel for the appellant that a letter dated 22.06.2015 is already filed before the registry to list the matter under the caption "for withdrawal". It is now submitted that the counsel has been instructed to withdraw the appeal.

Recording the said submission, the second appeal is dismissed as withdrawn. No order as to costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
