THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.31089 of 2015 ORDER:
The grievance of the petitioner was that the police authorities were inactive upon her complaints dated 28.06.2015 and 30.06.2015. However, the Sub-Inspector of Police, Penugonda Police Station, West Godavari District, furnished written instructions dated 01.10.2015 to the office of the learned Government Pleader for Home, wherein he stated that the subject complaints were never received. He further stated that upon the petitioner's earlier complaints, Crime Nos.195 of 2014 and 35 of 2015 were registered on the file of Penugonda Police Station and both the cases are pending trial before the competent Criminal Court.
In the light of the aforestated stand of the police authorities, Smt. K.Aruna, learned counsel for the petitioner, stated that the petitioner may be granted leave to file a fresh complaint before the police authorities in accordance with law.
In that view of the matter, the writ petition is disposed of permitting the petitioner to file a fresh complaint, if necessary, in accordance with law before the police authorities concerned.
