The present writ petition is filed questioning the proceedings dated 04.06.2007 issued by the 1st Respondent suspending the petitioner from service and filing charge sheet against him. When the matter came up for hearing, it is represented by the learned counsel for the petitioner that after issuing the impugned suspension proceedings and after conducting regular surcharge proceedings against him, the petitioner was allowed to retire from service and that now the only issue for consideration in this writ petition is payment of terminal benefits to the petitioner. Perused the material on record.

Since the issue relating to payment of terminal benefits to the petitioner is not the subject matter of the present writ petition, and all the issues viz., as to whether the petitioner is entitled for terminal benefits and how the suspension period has to be treated are to be dealt with and decided by the respondents after giving an opportunity of hearing to the petitioner.

In that view of the matter, the writ petition is disposed of directing the respondents to consider the issue of treating the

suspension period and payment of retiral benefits to the petitioner after giving opportunity to the petitioner within a period of two (02) months from the date of receipt of the copy of the order. Miscellaneous Petitions, if any, pending in this writ Petition shall stand closed.
