THE HON'BLE SRI JUSTICE PRAVEEN KUMAR WRIT PETITION No. 17449 of 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare. With the consent of both the parties, the writ petition is disposed of at the admission stage.

Questioning the show cause notice bearing SR.No.48/2014 issued by the Special Deputy Collector (Tribal Welfare), K.R.Puram, West Godavari District, the present writ petition is filed. Though various grounds are raised in the writ petition, learned counsel for the petitioner submitted across the Bar that pursuant to the notice issued, the petitioner appeared before the authorities on 22.01.2015 with all the relevant documents in support of the plea that the said authority has no jurisdiction to issue the show cause notice. But, till date, no order has been passed by the third respondent.

Learned Government Pleader submits that the question of quashing the show cause notice issued in the month of December, 2014, may not be appropriate at this stage, since the petitioner appeared before the concerned authority and placed all the material in support of his plea.

Having regard to the circumstances stated above and without going into merits of the case, the writ petition is disposed of directing the third respondent to pass orders to the objections raised in the show cause notice bearing SR.No.48/2014, if the same is still pending consideration, within a period of four weeks from today, after hearing the petitioner, if he is not heard till date. It is needless to mention that the authorities shall consider all the documents and

the judgments placed by the petitioner, while passing the order. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs. _____________________ JUSTICE PRAVEEN KUMAR 07.06.2016, vhb
