THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.18012 OF 2017 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Home for the State of Andhra Pradesh. With their consent, the present writ petition is disposed of at the admission stage itself.

2.

Since this Court is not going into the merits of the case, it may not be necessary to issue notice to the 7th respondent. 3.

The Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking implementation of the order, dated 03.01.2017, in I.A.No.315 of 2016 in I.A.No.165 of 2016 in O.S.No.51 of 2016, passed by the Junior Civil Judge, Bhimadole, West Godavari District, wherein the learned Junior Civil Judge is alleged to have granted police aid to the petitioner. 4.

Though the learned counsel for the petitioner tried to contend that in spite of making representations to the authorities, they have not provided any police aid, but no document is filed to show that such a representation was made before the police. He submits that the representation made by the petitioner, was to take action against the offender, who is encroaching into the subject property, but not for grant of police protection.

CPK,J WP_18012_2017 5.

In view of the submission made by the learned counsel for the petitioner, the petitioner is permitted to make a fresh representation seeking police protection in view of the order dated 03.01.2017 passed in I.A.No.315 of 2016 in I.A.No.165 of 2016 in O.S.No.51 of 2016 by the Junior Civil Judge, Bhimadole, West Godavari District. 6.

The same is not seriously objected by the learned Government Pleader.

7.

Having regard to the above, the Writ Petition is disposed of directing the petitioner to make a fresh representation seeking police protection in view of the order, dated 03.01.2017 passed by the Junior Civil Judge, Bhimadole, West Godavari District, in I.A.No.315 of 2016 in I.A.No.165 of 2016 in O.S.No.51 of 2016, within a week from today, in which event, the same shall be dealt with in accordance with law, within a period of one week thereafter. Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. _______________________ JUSTI CE C.
