THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.368 of 2010 JUDGMENT:

This appeal is filed by the plaintiff, under Section 100 CPC, assailing the judgment and decree dated 19.01.2010 in A.S.No.53 of 2005 on the file of District Court, Chittoor, wherein whereby the decree and judgment dated 01.03.2005 passed in O.S.No.47 of 2002 on the file of II Additional Junior Civil Judge Court, Chittoor, decreeing the suit filed by the plaintiff for perpetual injunction, was reversed.

At the time of hearing, learned counsel for the appellant seeks permission of this Court to permit the appellant to withdraw the appeal. To that effect, he also filed a letter in the Registry.

Permission as sought for is accorded.
