HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.35003 of 2012 ORDER:

This writ petition was filed for the following relief: "A Writ of Mandamus may be issued declaring the action of the respondent authorities in allowing respondents 2 and 3 to proceed with the investigation of the cases i.e., F.I.R.No.108 of 2011 dated 29.12.2011 and F.I.R.No.11 of 2012 dated 10.02.2012 lodged by the petitioner herein, in spite of the enquiry going on against respondents 2 and 3 at the instance of the complaint made by the petitioner against them to the 1st respondent, as illegal, arbitrary and opposed to the established principles of law and consequently direct the 1st respondent to transfer the investigation of the above mentioned F.I.Rs to an independent agency."

Though a counter-affidavit was filed in the year 2012, now the learned Government Pleader for Home (AP), on the basis of the instructions, submits that the Investigating Officer, Pamur Circle referred the cases in Crime Nos.108 of 2011 and 11 of 2012 as false on 10.12.2012 and 07.02.2013 respectively after obtaining orders from the Sub-Divisional Police Officer, Kandukur and filed final reports in the Court of the Additional Judicial Magistrate of First Class, Kandukur. In the circumstances, liberty is given to the petitioner to file protest petitions to the said final reports, if he is so interested. Accordingly, the Writ Petition is closed. No order as to costs.
