THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1281 OF 2016 ORDER:
The petitioner has preferred the present criminal revision case by invoking the provision under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 28.03.2016 passed in Crl.M.P.No.875 of 2016 by the Court of the XIII Additional Chief Metropolitan Magistrate (Mahila Court) at Hyderabad, whereby the Court below dismissed the petition filed under Section 439 CrPC seeking to relax the condition imposed on the petitioner while granting bail. Heard and perused the material available on record. Learned counsel for the petitioner submits that the petitioner is an employee in Australia and he came to India on a sudden demise of his brother-in-law. He further submits if the petitioner does not join his job in Australia, he would lose his job and to that extent he has received a mail from his employer. Hence, he prays this Court to set aside the order impugned and direct the Court below to release the passport and permit the petitioner to move to Australia.
In the facts and circumstances of the case, the petitioner is directed to file an application before the Court below seeking release of passport and on such filing, the Court below is directed to return the passport to the petitioner herein on deposit of an amount of Rs.3,00,000/- (Rupees three lakhs only) and also on executing an affidavit that he shall appear when the trial Court insists for his appearance, and also permit the petitioner to go abroad.
The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
