THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.10118 OF 2010 ORDER:

This Writ Petition is filed for the following relief: "... to issue an order or direction more particularly one in the nature of Writ of Mandamus by, (a) declare the action of the respondents in not releasing the pensionary benefits to the petitioner is arbitrary, illegal and violative of Articles 14, 16 and 21 of the Constitution of India;

(b) direct the respondents to release the pension and pensionary benefits with all consequential benefits including arrears w.e.f. 01.07.2004 with interest @ 18% per annum for the delayed payment of pension and pensionary benefits etc., (c) and further direct the respondents to pay a compensation of Rs.5.00 lakhs for the needless litigation thrusted on the petitioner and initiate departmental action against the 3rd respondent for unnecessarily delaying the payment of pension without any valid reason and ground and pass such other and further order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Sir B. Nalin Kumar, learned counsel representing the 3rd respondent - College submits that all the retirement benefits of the petitioner are settled and pension is being paid. 3.

Having regard to the said submission, no further orders are required to be passed in the Writ Petition.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
