THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N.BALAYOGI CONTEMPT CASE NO.858 OF 2018

O R D E R

(Per Hon'ble Sri Justice Sanjay Kumar) This contempt case was instituted alleging willful disobedience to the order dated 02.06.2017 passed by this Court in W.P.No.13624 of 2015. By the said order, this Court directed the Chief Conservator of Forests, Andhra Pradesh, to consider the case of the petitioner herein for promotion to the post of Senior Assistant in the existing vacancy as per rules, if he is otherwise qualified and eligible for the said post. In the first instance, proceedings dated 21.06.2018 were issued by the Chief Conservator of Forests, Government of Andhra Pradesh, stating that the petitioner herein was considered for promotion as a Senior Assistant subject to the clarification from the Principal Chief Conservator of Forests, Andhra Pradesh, and the Government and also to avoid contempt proceedings before this Court.

As this Court found fault with the manner in which the order had been complied with by making it subject to the approval of various authorities, the Chief Conservator of Forests, Andhra Pradesh, now issued proceedings dated 25.09.2018 in partial modification of the earlier proceedings dated 21.06.2018 stating to the effect that the petitioner was promoted as a Senior Assistant and posted in the office of the Divisional Forest Officer, WLM Division, Rajamahendravaram with effect from the date of reporting in the place of posting.

In the light of this later order, we are satisfied that the order in the writ petition has been sufficiently complied with. The contempt case is accordingly closed. No order as to costs. ______________________ SANJAY KUMAR, J ____________________ N.BALAYOGI , J 16th NOVEMBER, 2018 Svv
