THE HON'BLE SRI JUSTICE S. RAVI KUMAR CIVIL MISCELLANEOUS APPEAL No.1097 of 2008 JUDGMENT:

When the matter came up on 14.07.2016, at request of advocate for appellant, the matter is directed to be posted along with CMA(SR) No.51710 of 2004. As per the office endorsement, said CMA(SR) No.51710 of 2004 was returned on 10.04.2006 and it appears it is not represented. Once the matter was posted under the caption "For Dismissal" and at request of advocate for appellant, matter was removed from that caption. Today when the matter is taken up, neither the advocate for appellant appeared nor is any representation made on his behalf.

2. Considering these aspects, the appeal is dismissed for nonprosecution. Miscellaneous petitions, if any, pending in this appeal shall stand dismissed.
