THE HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.5425 of 2017 ORDER:

This writ petition is filed challenging the action of the respondents in not issuing work order in order to enable the petitioner to submit the tender pursuant to tender notice for carrying out repairs to Phase 1 and Phase 3 Distribution Transformers for the year 2016-2017.

The main grievance of the petitioner is that his service as Sub-contractor should be taken into consideration for qualifying him to be eligible to the bid for the tender. When the said dispute is pending and the tender process is completed and tender was also awarded to some 3rd party.

In view of the same, the matter relates to the eligibility as per tender condition and it cannot be adjudicated after completion of tender process.

However, it is open to the petitioner to challenge the award of contract in favour of 3rd respondent if the petitioner is so aggrieved. Accordingly, this Writ Petition is dismissed as infructuous. No costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
