HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO CONTEMPT CASE No. 2289 OF 2016 ORDER:

This Contempt Case was filed alleging violation of order in WPMP No. 27913 of 2016 in W.P.No. 22702 of 2016 dated 24.8.2016. This Court passed an interim order on that date directing the respondents to continue the services of the petitioners until further orders.

Instead of complying with the said order, the erstwhile Chairman, Agricultural Market Committee, Kalyandurg, disobeyed the orders and later on relinquished his Office. When Contempt proceedings were taken against him asking him to be present before this Court, he appeared before this Court and pleaded that he passed only 8th standard and he was guided by the first respondent and he has no intention to violate the orders. The first respondent on the other hand submitted that in view of the orders of the Chairman, he could not implement the orders, and thus blamed each other. In those circumstances, a last chance was given to respondents for implementing the orders and pursuant to the same, now the first respondent produced before this Court a copy of the order dated 6.2.2017 directing the petitioners to continue in service by making a request to their outsourcing agency.

At this state, learned counsel for petitioners submitted that since they were kept out of employment, at least till the date of passing of the orders, they should be paid wages for the period they were kept out of employment. The said issue is kept open in the main Writ Petition. However, since the present Contempt Case arises out of an interim order, in view of the implementation of the interim order, further proceedings in this Contempt Case are dropped.

Accordingly, this Contempt Case is closed.
